Acceptance of Terms

These Terms & Conditions ("Terms") govern your access and use of the ice bath services ("Services") at Performance Place, operated by Prime Padel. By using the Services, you agree to be bound by these Terms. If you do not agree, you must refrain from using the Services.

Purpose and Eligibility

1. Performance Only: The ice bath is provided strictly as a recovery and performance service. It is not a social amenity or leisure spa.

   
   

2. Non-Members Welcome: You do not need to be a Prime Padel member to access Performance Place, but you must be a registered player using our courts or facilities.

   
   

3. Legal Age: You must be of legal age and capable of forming a binding contract. Individuals under 18 must have parental or legal guardian consent before use.

Health Risks

Use of cold water immersion carries inherent risks, particularly for individuals with the following:

1. Cardiovascular conditions

   
   

2. Respiratory issues

   
   

3. Diabetes

   
   

4. Cold sensitivity disorders (e.g., Raynaud’s)

   
   

5. Pregnancy

   
   

You are responsible for consulting a medical professional prior to use.

Voluntary Use and Assumption of Risk

Your use of the ice bath is voluntary and entirely at your own risk. By participating:

1. You accept full responsibility for your health and well-being.

   
   

2. You acknowledge that cold immersion can cause dizziness, numbness, or other adverse effects.

   
   

3. You waive and release Prime Padel, its officers, employees, contractors, and affiliates from any liability for injury, illness, loss, or damage sustained during or arising from use.

   
   

Safe Practice Guidelines

To ensure safe and effective use, you must:

1. Limit sessions to 5–10 minutes, unless advised otherwise by a qualified professional.

   
   

2. Enter and exit the bath slowly to avoid slipping or shock.

   
   

3. Never use the bath alone – someone must be nearby to assist in case of emergency.

   
   

4. Do not use the ice bath under the influence of alcohol, drugs, or medications that impair circulation or judgment.

Acceptable Use Policy

You shall:

1. Be respectful, clean up after yourself, and keep the area dry and safe.

   
   

2. Follow all posted signage and instructions from staff.

   
   

3. Wear appropriate athletic attire. Nudity is strictly prohibited.

   
   

4. Refrain from disruptive, inappropriate, or illegal conduct, including harassment, vandalism, and unauthorised training or solicitation.

   
   

5. Not take commercial photos/videos without prior written consent.

   
   

6. Be considerate of shared use and not hog facilities or equipment.

Disclaimers

1. Services are provided "as is" and "as available" without warranties of any kind.

   
   

2. Availability may be subject to temporary suspension due to maintenance, cleaning, events, or operational requirements. We aim to provide reasonable notice but are not obligated to do so.

   
   

3. Prime Padel disclaims all representations, warranties, and liabilities regarding the suitability, safety, or effectiveness of the Services.

   
   

4. No Medical Advice: The Services do not constitute medical advice. You should consult a licensed medical professional before undertaking any new recovery regimen.

Limitation of Liability

To the fullest extent permitted by law, our maximum aggregate liability to you for any claims, losses, or damages arising out of or related to your use of our Services is limited to the total amount paid by you for the Performance Place Services in the twelve (12) months prior to the event giving rise to the liability. For the avoidance of doubt, this limitation applies strictly to Performance Place Services only and does not include any Padel or court-related services or bookings.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business, goodwill, data, or other intangible losses, even if advised of the possibility of such damages.

Indemnity

You agree to indemnify, defend, and hold harmless Prime Padel and its affiliates, officers, employees, contractors, and representatives from any claims, damages, liabilities, or costs arising from:

1. Your use of the Services

   
   

2. Your breach of these Terms

   
   

3. Any injury or damage caused to yourself or others during use

Force Majeure

We shall not be liable for any delay or failure to perform our obligations due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, fire, flood, power outages, or governmental actions.

Sole Remedy

Your sole and exclusive remedy for dissatisfaction with our Services is to cease use of the Services. We are not obliged to provide any refund or compensation beyond what is outlined in these Terms.

Booking & Session Duration

All ice bath sessions must be booked in advance at the front desk. Each session is limited to 60 minutes, including preparation and cooldown time. We reserve the right to terminate your session to ensure fair access for all users.

Right to Refuse or Revoke Access

We reserve the right to deny or revoke access to any user who:

1. Appears intoxicated or medically unfit for safe use

2. Breaches these Terms or facility rules

3. Acts in a manner that endangers themselves, staff, or other users Our decision in such matters shall be final.

Third-Party Providers

From time to time, third-party professionals (e.g., therapists, recovery specialists) may operate at our facilities. Any interaction or engagement with them is strictly between you and the third party. Prime Padel is not liable for any outcome resulting from third-party services.

Modification of Terms

We reserve the right to amend these Terms at any time to reflect changes in law, best practices, or service features. Continued use of our Services after changes constitutes your acceptance. If you disagree, you must immediately stop using the Services.

Dispute Resolution

These Terms are governed by the laws of Singapore. If a dispute arises:

1. You must first issue a written Notice of Dispute.

   
   

2. Both parties must attempt in good faith to resolve the dispute within 30 days.

   
   

3. If unresolved, the dispute shall be submitted for mediation at the Singapore Mediation Centre (SMC).

Entire Agreement and Severability

These Terms constitute the entire agreement between you and Prime Padel regarding Performance Place. If any part is deemed unenforceable, the remaining provisions remain in full force and effect.

Survivability

Clauses relating to limitation of liability, indemnity, dispute resolution, sole remedy, disclaimers, and data privacy shall survive termination of access or use of the Services.
